These terms govern the use of the site and the conditions under which Gweva Legal Force makes the Ria network's money transfer service available at its branch. They do not replace Ria's terms applicable to the transfer operation itself.
1.Purpose
The purpose of these general terms is to set out how the site may be used and the conditions under which the customer may use, at the GLF counter, the money transfer service operated through the Ria network. Any use of the service implies prior and unreserved acceptance of these terms.
2.Operator
The site and the service point are operated by the sole proprietorship Arnaud Franchini, trading as Gweva Legal Force ("GLF"), 70 Impasse du Bellay, 83700 Saint-Raphaël — SIRET 539 798 835 00051 — phone 04 98 13 00 45 — email guichet@gweva.fr.
3.Nature of the service and GLF's role
Money transfer is a payment service provided by Ria, a licensed payment institution authorised to provide payment services in France.
GLF acts solely as a partner service point of the Ria network. As such, GLF's role is limited to:
- welcoming and informing the customer;
- verifying the identity of the payer;
- entering the transfer order;
- collecting the funds on behalf of Ria;
- providing the customer with a receipt for the operation.
The contract for the transfer operation is concluded between the customer and Ria. This operation is governed by Ria's terms, provided to the customer, which it is for the customer to read and accept before any operation. In the event of any discrepancy between these terms and Ria's, the latter prevail for everything concerning the payment operation itself.
4.Conditions of access to the service
The service is reserved for natural persons of legal age and with legal capacity. Presentation of valid photo ID (national identity card, passport or residence permit) is mandatory for any operation.
Under anti-money-laundering and counter-terrorist-financing regulations, GLF is required to verify the payer's identity and may request additional information or supporting documents, in particular on the origin of the funds and the purpose of the operation.
GLF, like Ria, may refuse, suspend or delay an operation, in particular in the event of doubt, suspicion, incomplete information, exceeding a limit or non-compliance with regulations, without this giving rise to any right to compensation. Amount limits apply in accordance with the regulations and the rules of the Ria network.
5.How a transfer works
At the counter, the customer provides the destination country, the amount to be transferred and the recipient's details. After verification and payment, a transfer number or code is given to the customer. The recipient can then collect the funds according to the payout method available in the destination country (cash pickup, bank account deposit or mobile wallet). Availability times depend on the destination and the payout method.
6.Pricing and fees
The applicable transfer fees and exchange rate depend on the destination country, the amount transferred and the chosen payout method. The exact fee amount and the exchange rate are communicated to the customer before the operation is confirmed. No fixed price list is guaranteed; pricing may change in line with Ria's terms. Payment is made in cash, at the counter.
7.Cancellation and refund
The customer may request cancellation of a transfer as long as the funds have not been made available to or collected by the recipient, in accordance with the procedures, time limits and conditions set by Ria. Any refund is made in accordance with those conditions; certain fees may remain payable under the rules of the Ria network.
As this is a payment service executed at the customer's request, no right of withdrawal applies once the transfer has been completed.
8.Receiving funds
To collect a transfer at the GLF counter, the recipient presents valid photo ID and the transfer code provided by the sender. The funds are handed over according to the method set for the operation.
9.Customer's obligations
The customer warrants the accuracy of the information they provide. They are solely responsible for the consequences of any error in the recipient's identity or details. The customer undertakes not to use the service for unlawful or fraudulent purposes or in breach of regulations.
10.Liability
GLF is answerable for the obligations incumbent on it in its capacity as a partner service point. Performance of the payment service — in particular time frames, availability of funds, network operation and the paying institution — is Ria's responsibility.
GLF cannot be held liable for any delay, suspension or non-performance attributable to the Ria network, the paying institution, incorrect or incomplete information provided by the customer, or an event of force majeure.
11.Personal data
The customer's personal data is processed for the purposes of performing the service and complying with legal obligations, in particular regarding anti-money-laundering and counter-terrorist-financing. The processing arrangements, the customer's rights and the available remedies are set out in the site's legal notice.
12.Intellectual property
The site and its components are protected by the French Intellectual Property Code. Any unauthorised reproduction or use is prohibited. The "Ria" trademarks and logos remain the property of their owner.
13.Complaints
Any complaint regarding the use of the site or the reception at the service point may be sent to GLF: by post to 70 Impasse du Bellay, 83700 Saint-Raphaël, by email to guichet@gweva.fr, or by phone on 04 98 13 00 45.
Complaints concerning the performance of a transfer operation fall within the payment service; they may be brought before Ria according to the procedures set out in Ria's terms.
14.Governing law and jurisdiction
These terms are governed by French law. Failing an amicable resolution, any dispute relating to their interpretation or performance will be brought before the competent French courts.
